1.Introduction

Welcome to Snitchnotes ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Snitchnotes application and services (collectively, the "Service"), which provide AI-powered note-taking and quiz creation tools for students.

The Service is operated by Moss Studios (d.b.a Snitchnotes), located at 2803 Philadelphia Pike, Suite B #1702, Claymont, DE 19703.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2.Acceptance of Terms

By creating an account and using our Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all users who access or use the Service.

3.Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4.Account Registration

To use Snitchnotes, you must create an account by signing up with Google or providing a valid email address. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account

4.2 Account Responsibility

You are solely responsible for all activities that occur under your account. You agree not to:

  • Share your account credentials with others
  • Allow others to access your account
  • Create multiple accounts for fraudulent purposes
  • Impersonate another person or entity

5.Service Description

Snitchnotes provides AI-powered tools to help students with note-taking and studying, including:

  • Converting source materials (PDFs, text, YouTube links, audio files) into organized notes
  • AI-generated note creation and enhancement
  • Note editing and management
  • Quiz generation from your notes
  • Quiz-taking and answer tracking
  • AI chat assistant for answering questions about your notes and study materials

6.User Content and Data Storage

6.1 Content You Provide

When you use Snitchnotes, you may upload or provide:

  • Source materials (PDFs, text documents, audio files, YouTube links)
  • Your own notes and edits
  • Quiz answers and responses

6.2 Ownership of Your Content

You retain all ownership rights to the content you upload or create ("User Content"). By using our Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Store, process, and display your User Content
  • Use AI technology to generate notes from your source materials
  • Create quizzes based on your notes
  • Provide the Service features you request

This license exists solely to operate and improve the Service and terminates when you delete your content or account.

6.3 Data Storage

We store the following data:

  • Your uploaded source materials
  • AI-generated and user-edited notes
  • Quiz questions generated from your notes
  • Your quiz answers and performance history
  • Account information and settings

All data is stored securely on our servers and is protected in accordance with industry standards and applicable data protection laws.

6.4 Your Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to upload all source materials
  • Your content does not violate any laws, regulations, or third-party rights
  • Your content does not infringe on copyrights, trademarks, or other intellectual property
  • You have permission to upload any copyrighted educational materials (textbooks, articles, etc.)
  • You comply with all applicable institutional policies regarding recording and distribution of educational content

Important: You are responsible for ensuring you have the legal right to upload and process any educational materials, including textbooks and course materials. We are not responsible for any copyright infringement resulting from your uploads.

6.5 Compliance with Educational Institution Policies

Users must not upload any material that contravenes the policies set by their school, college, university, workplace, or instructor, including but not limited to:

  • Unauthorized recordings of lectures or classroom sessions
  • Course materials explicitly prohibited from distribution by instructors
  • Examination questions, answers, or assessment materials
  • Content that violates your institution's academic integrity code

It is your sole responsibility to understand and comply with your institution's rules regarding the recording, uploading, and use of educational materials.

6.6 Recording and Privacy Laws

Users must comply with all applicable privacy and recording laws. You are prohibited from:

  • Recording or uploading conversations without proper consent as required by applicable law
  • Sharing sensitive, confidential, or private communications
  • Uploading content that violates privacy rights of instructors, students, or third parties
  • Recording lectures or classroom sessions where prohibited by law or institutional policy

State Recording Laws: Be aware that recording laws vary by jurisdiction. Some states require all-party consent for recording conversations. You are responsible for understanding and complying with the laws applicable to your location.

7.Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purposes
  • Upload malicious files or content (viruses, malware, etc.)
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or attempt to extract our AI models or algorithms
  • Use the Service to violate academic integrity policies
  • Share or distribute generated content that violates copyright laws
  • Abuse, harass, or harm other users
  • Use automated systems (bots, scrapers, crawlers, or data mining tools) without written permission
  • Resell or redistribute the Service without authorization
  • Share your account credentials or subscription access with others
  • Access the Service through more than a reasonable number of devices simultaneously

8.AI-Generated Content

8.1 Nature of AI Content

Our Service uses artificial intelligence to generate notes and quizzes. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or incomplete information.

8.2 No Warranty on Accuracy

We do not guarantee that AI-generated notes or quizzes are:

  • Completely accurate or error-free
  • Suitable for your specific academic needs
  • A replacement for reading source materials
  • Acceptable under your institution's academic policies

8.3 Your Responsibility

You are responsible for:

  • Reviewing and verifying all AI-generated content
  • Ensuring the accuracy of notes before relying on them
  • Complying with your educational institution's policies on AI use
  • Using the Service as a study aid, not a replacement for learning

8.4 Game Modes and Entertainment Features

Snitchnotes may include gamified quiz modes, such as "Who Wants to Be a Millionaire" style formats, to make studying more engaging. These features are for educational and entertainment purposes only.

IMPORTANT: No real money, prizes, or rewards of monetary value are awarded through any game modes or quiz features. All points, scores, virtual currency, or prizes referenced in game modes are purely fictional and have no real-world value. The Service does not constitute gambling, gaming, or a contest with real prizes.

9.Subscriptions and Payments

9.1 Subscription Plans

Certain features of Snitchnotes may require a paid subscription. Subscription details, pricing, and features are available within the app.

9.2 Billing

Subscriptions are billed in advance on a recurring basis (weekly, monthly or annually)

Your subscription will auto-renew unless you cancel before the renewal date

Payment is processed through third-party payment processors (such as Stripe, Apple App Store, or Google Play Store)

9.3 Cancellation

You may cancel your subscription at any time through your account settings or the relevant app store

Cancellation will take effect at the end of your current billing period

You will retain access to paid features until the end of the paid period

No refunds will be provided for partial subscription periods

9.4 Price Changes

We reserve the right to modify subscription fees. You will be notified at least 30 days before any price changes take effect. Continued use after the price change constitutes acceptance of the new pricing.

9.5 Refunds

General Policy: Subscription fees are non-refundable except as required by law.

App Store Purchases: For subscriptions purchased through the Apple App Store or Google Play Store, refunds are governed by the respective store's refund policy. Please contact Apple or Google directly for refund requests on in-app purchases.

Direct Purchases: For subscriptions purchased directly through our website or app (via Stripe or other payment processors), refunds may be considered on a case-by-case basis within 7 days of purchase if you have not actively used the Service.

How to Request: If you believe you are entitled to a refund or wish to discuss any billing issues, please contact us at hello@mosslabs.co with your account details and reason for the request.

Legal Rights: This policy does not affect your statutory rights under applicable consumer protection laws.

9.6 Free Trials

We may offer free trial periods. Unless you cancel before the trial ends, you will be automatically charged for the subscription.

10.Intellectual Property

10.1 Our Property

The Snitchnotes Service, including its software, design, features, algorithms, and branding, is the exclusive property of Moss Studios and is protected by copyright, trademark, and other intellectual property laws.

10.2 Restrictions

You may not:

  • Copy, modify, or distribute our software or Service
  • Use our trademarks or branding without permission
  • Remove any copyright or proprietary notices
  • Create derivative works based on our Service

10.3 DMCA Compliance and Copyright Infringement

Snitchnotes complies with the Digital Millennium Copyright Act (DMCA). We respect the intellectual property rights of others and expect our users to do the same.

Reporting Copyright Infringement:

If you believe that content on Snitchnotes infringes your copyright, please send a written notice to hello@mosslabs.co including:

  • Your contact information (name, address, phone, email)
  • A description of the copyrighted work claimed to have been infringed
  • A description of where the infringing material is located on our Service
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Consequences of Infringement:

Upon receipt of a valid DMCA notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who uploaded the content
  • Terminate repeat infringers' accounts

Counter-Notice: If you believe your content was removed in error, you may submit a counter-notice as provided under the DMCA.

11.Privacy and Data Protection

11.1 Privacy Policy

Your use of Snitchnotes is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11.2 Data Rights

If you are located in the European Economic Area, United Kingdom, or California, you may have additional rights regarding your personal data, including:

  • Right to delete your data
  • Right to restrict processing

  • Right to object to processing

11.3 Data Security

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of AI-generated content
  • Warranties that the Service will meet your academic requirements

14.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOSS STUDIOS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or academic standing
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from reliance on AI-generated content
  • Damages resulting from unauthorized access to your account

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

15.Indemnification

You agree to indemnify, defend, and hold harmless Moss Studios, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your uploaded content or materials

16.Termination

16.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

16.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the Service or harm other users
  • Fail to pay subscription fees
  • Infringe on intellectual property rights
  • Violate academic integrity policies
  • Upload prohibited content repeatedly

Enforcement Actions:

Depending on the severity and frequency of violations, we may take the following actions:

  • Issue a warning
  • Remove specific content
  • Temporarily suspend your account
  • Permanently terminate your account
  • Report violations to your educational institution
  • Take legal action for serious violations

16.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and all associated data
  • You remain responsible for any outstanding fees
  • Provisions regarding liability, indemnification, and dispute resolution survive termination

17.Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Sending an email to your registered address
  • Displaying a notice in the app

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

18.Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

18.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Delaware, in accordance with the American Arbitration Association rules, except where prohibited by law.

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or representative proceedings.

19.Academic Integrity and Honor Code

19.1 Our Commitment to Academic Integrity

Snitchnotes is built on the principle that learning requires genuine effort, understanding, and personal growth. We are committed to supporting academic integrity and believe that our AI-powered tools should enhance—not replace—the learning process.

19.2 Intended Use

Our Service is designed to:

  • Help you organize and understand course materials
  • Facilitate active studying through note-taking and review
  • Reinforce learning through self-assessment via quizzes
  • Make studying more engaging through gamification

Our Service is NOT intended to:

  • Replace reading, studying, or attending classes
  • Enable cheating on exams, assignments, or assessments
  • Facilitate plagiarism or academic dishonesty
  • Share or distribute test content or answers

19.3 Prohibited Academic Dishonesty

The following actions are strictly prohibited and constitute violations of our Honor Code:

  • Sharing Assessment Content: Uploading, sharing, or distributing examination questions, test answers, quiz solutions, or any assessment materials
  • Plagiarism: Submitting AI-generated content as your own original work without proper attribution or in violation of your instructor's policies
  • Unauthorized Collaboration: Using Snitchnotes to facilitate cheating or share answers with others during assessments
  • Circumventing Restrictions: Using our Service in ways that violate your institution's policies on AI tools or study aids

19.4 Consequences of Violating Academic Integrity

We take academic dishonesty seriously. If we identify misuse of our platform for academic dishonesty, we will:

  • Immediately remove the violating content
  • Suspend or terminate the offending user's account
  • Cooperate fully with educational institutions in their investigations
  • Reserve the right to share publicly posted content and user information with universities and academic institutions
  • Report serious violations to appropriate authorities

19.5 Educational Values

As creators who understand the pressures of academic life, we recognize that students face demanding schedules and significant stress. However, we firmly believe that shortcuts through academic dishonesty offer no true benefit. Simply copying answers or plagiarizing content may help complete a task, but it undermines the fundamental goal of education: learning, comprehension, and personal growth. We trust our users to use Snitchnotes ethically and in accordance with their institution's academic integrity policies. Your success should be built on genuine understanding, not shortcuts that compromise your education.

20.General Provisions

20.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Moss Studios regarding the Service.

20.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions will continue in full effect.

20.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

20.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

20.5 Force Majeure

We are not liable for any failure or delay due to circumstances beyond our reasonable control.
